Can disability benefits be terminated? Find out all about disability benefit termination & more here.

As a social security lawyer in Buffalo, NY,  we deal with all aspects of the social security process for our clients. That being said, we work with cases involving Social Security Disability Insurance (SSDI) or Supplemental Security Income (SSI) benefits. We know how important disability benefits are to those that are unable to work. If your disability benefits are terminated for any reason, it can be alarming. Disability benefits are subject to termination for a variety of reasons. Although it is rare, it can still happen. Read on to discover the reasons that disability benefits can be terminated.

Retirement

Your disability benefits will come to a halt when you reach full retirement age. This depends on the year you were born. At that moment, your disability benefits automatically switch to retirement benefits.

Arrest or Jail Time

If you are receiving SSI disability benefits when you are arrested and facing charges, your benefits will stop after you have been incarcerated for one month; your benefits will resume upon proof of release from prison.

Improvement of Condition

Although termination of benefits is rare, another common reason would be if the condition of your disability has improved. As an adult, you could lose your benefits if your condition has improved medically as it relates to your ability to work.

Children Disability Benefits Termination

Prior to their eighteenth birthdays, children receiving disability benefits will be reviewed to ensure they can still receive the benefits. If the child is disabled, they most likely will continue to receive their benefits. If the child is receiving the benefits by collecting benefits based on a disabled parent’s work record, they can be terminated.

To summarize the above points, if SSA finds that you are physically able to partake in gainful activity once reviewing your case, your disability benefits can be terminated. This is because your condition is no longer disabling enough to qualify for the benefits. SSA will also consider the fair market value of volunteer labor and may terminate your benefits, even if you are not working to receive income.
